The events for which he was tried occurred on December 1, 2014, date on which the company Sport Link SAS, which Calle represents, allegedly acquired a property worth 530,000,000 million pesos.
According to the ruling, the amount was not immediately deposited with the sellers, Mario Márquez Sarmiento and Lilian Polanco Gasca, since Calle had barely given them 200,000,000 million pesos .
In order to pay the remaining amount, that is, 330,000,000 million pesos, the property for sale was mortgaged in favor of Márquez and Polanco.
To Márquez's surprise, according to the ruling, a year after the deal was made, in January 2015, he received an email from Calle's brother, Alejandro, informing him that they had been approved for a real estate leasing contract ( financial leasing that allows the use of a property in exchange for paying monthly installments).

The contract was worth 600,000,000 million pesos.
Of the approved amount, it was established that 330,000,000 million pesos would be consigned to the initial sellers of the property by the banking entity Helm Bank: "$165,000,000 will be transferred to Mario Alberto Márquez Sarmiento and $165,000,000 to Lilian Planco Gasca," according to the ruling.
The above, taking into account that Calle had declared himself a debtor of the sum of 330,000,000 million pesos.
After learning of the situation, Márquez and Polanco decided to cancel the mortgage , hoping that the agreed money would be transferred to them, but this was not the case.

"Thus, it would be demonstrated that the defendant, by sending the leasing approval letter , deceived the sellers into believing that the payment of the debt was assured and thus they agreed to the lifting of the mortgage so that apparently after it was lifted, Lilian Polanco Gasca and Mario Alberto Márquez Sarmiento could receive the $330,000,000 pesos," according to the ruling.

On April 8, 2016, both sellers received a notification that would make them doubt the business they had done with the 'influencer's' father, since Calle was in charge of "changing the instructions of the approved Lease, ordering the bank to disburse all the money to his personal bank account ."
Upon seeing the businessman's actions , Márquez and Polanco decided to file a complaint against him , for which Calle was formally charged by the Prosecutor's Office for aggravated fraud on April 27, 2022.
However, it was not until February 7, 2025 that the 45th Criminal Circuit Court with Knowledge Function of Bogotá found him guilty, sentencing him to five years in prison.

After learning of the sentence, Germán Calle reported in a statement that he was "unfairly and surprisingly" notified of the sentencing decision.
Likewise, the businessman stated that "the decision is not final," since his defense filed an appeal , which is in the Superior Court of Bogotá.
Calle mentioned that the Court that took charge of the criminal process " disregarded" the public deeds that were allegedly signed with Márquez and Polanco : "it issued the questioned decision against my interests," the document states.
So far, the well-known influencer has not commented on the verdict.
