Judge Janine Otálora Malassis considered that the arrival of two new members to the Superior Chamber of the Electoral Tribunal of the Federal Judicial Branch (TEPJF), as well as the renewal of the presidency, will be beneficial to this highest court, as they are expected to change the criteria and dynamics that have long been expressed in the plenary session.

The National Electoral Institute validated and delivered the majority certificates to the two newly elected justices for the Superior Chamber of the TEPJF: Claudia Valle Aguilasocho and Gilberto de Guzmán Bátiz García; the latter would be the next president of the Electoral Tribunal.

With them, the full court of the highest electoral court will be fully integrated. For the past two years, it has been incomplete with only five judges. This allows the bloc composed of Chief Justice Mónica Soto Fregoso and Justices Felipe Fuentes Barrera and Felipe de la Mata Pizaña to prevail in rulings.

"In principle, the working dynamics could change. All of this will also depend on who presides over the Superior Chamber, the dynamics, and the proposals they bring. Definitely, the person who presides is somewhat like an orchestra conductor in some ways (...) Yes, it's likely that certain dynamics will be renewed, in short, which is, let's say, the great advantage of a phased renewal of the bodies. New people arrive, new criteria, new visions of ways of working," Judge Otálora Malassis told El Economista.

Regarding the presidency of the Superior Chamber, he indicated that the judge with the most votes will lead it.

The qualification of elections

In another matter, Judge Otálora Malassis emphasized that the TEPJF will face significant challenges, including analyzing the possibility of annulling the entire election if a candidate requests it.

"First, we will have to debate a jurisdiction to resolve challenges to regional chamber candidacies (...) We will also have to see, right now, the counts are being challenged (...) the big discussion will be whether a recount can be carried out and under what conditions and what authority is in charge, if applicable, of the vote count, which will also be an important issue," he said.

And he acknowledged that recounting votes for district court or collegiate court elections "is a more complex issue because of the ballot itself."

He also emphasized that the case of the annulled voting booths will be another matter of great importance, since, he noted, although the INE has already annulled just over 800 voting booths due to irregularities, it remains to be seen whether there are other voting booths that will need to be annulled or directly challenged before the TEPJF.

In addition to providing for the possibility that "finally, if a candidate arrives requesting the annulment of the election."

Regarding this, the judge expressed confidence that everything can be resolved before August 28, the deadline for concluding matters related to this election.
