"What the Court has done is so grotesque that I have no doubt that a serious, objective, and responsible analysis by international bodies will reach a contrary solution," Beraldi said in an interview with FM Millenium.
During the interview, the lawyer insisted that the former president cannot be convicted of the crimes charged against her in the Vialidad case . He also questioned the fact that the appeals were "shamefully" rejected by the Supreme Court.
" Due process demands that if someone challenges a judge, that decision must be resolved by another magistrate. Here, the judges themselves rejected their own challenges," he explained. Beraldi recalled that Horacio Rosatti, when he was a minister under Néstor Kirchner, had used the same argument to remove a judge in a personal case.
"Rosatti cited a well-known ruling, the Serena ruling, which establishes that it is not necessary to prove a lack of impartiality; rather, an 'objective fear' is sufficient. This applies to both judges and prosecutors," he said.
He also took aim at prosecutors Diego Luciani and Sergio Mola , accusing them of lacking objectivity. "Prosecutors must act impartially, and clearly in this case they failed to do so," he added.
Carlos Beraldi went further and warned of irregularities in the investigating court. "Judge Julián Ercolini was investigating while his wife was working at the Ministry of Justice and receiving a salary. This is clear cause to question his impartiality," he stated.
He also recalled that when judges Mariano Borinsky and Gustavo Hornos were challenged, they themselves rejected the claim. "Something similar also happened with Ricardo Lorenzetti . Who controls all of this? If the Supreme Court is the final court and simply dismisses the claims, everything remains unreviewed," he questioned.
Carlos Beraldi argued that the situation represents an institutional setback. “It would be catastrophic if, because of a particular political identity or because she was president, she were denied all guarantees.
