A resident of Przemyśl won against the city in court. The case ended in a family tomb

Mr. Antoni almost paid the fee twice for maintaining the right to a brick family grave (the so-called extension fee for leaving the grave intact for the next few years). The Przemyśl resident was asked to pay it based on the regulations of municipal cemeteries in the Przemyśl Municipal Commune, which was the result of a resolution of the city council from 2011. He did not give in, did not pay and took the case to court. The decision turned out to be favorable for him (!). The verdict became final, so Mr. Antoni decided to publicize the case again to show others that they have a chance of winning. "I encourage those who paid twice to apply for a refund of unjustly charged costs with interest," he says. How is that possible?
Let us recall. We described A. Święcicki's problem in September 2023, in the article "He was charged approximately PLN 5,000 in arrears for a brick family grave. - On what basis? - asks Mr. Antoni". It was about a brick family grave at the Main Cemetery on Słowackiego Street in Przemyśl, where members of his family are buried. In connection with subsequent burials, the grave was opened several times and eventually the ground caved in and everything began to collapse. Mr. Antoni considered demolishing the grave and rebuilding it, which is quite a financial burden. On the way, he encountered stairs. The cemetery manager demanded that he pay the arrears and cover the extension for the next 50 years. According to the Municipal Economy Department of the Przemyśl City Hall, with whom Mr. Antoni corresponded on this matter, the last burial in the family, brick tomb, which took place in 2006, did not result in the extension of the validity of the grave fee for another 50 years, because only a fee for the funeral costs was collected. The aforementioned Przemyśl City Hall unit referred to the resolution of the city council no. 94/2011 from 2011, which states that "the extension fee for leaving the grave intact should be paid within 6 months from the date of expiry of the paid cemetery fees for 50 years for a brick tomb". It was calculated that Mr. Antoni has to pay a total of about PLN 5,000 (this was supposed to include the outstanding fee for the tomb and the extension fee)...
