INSS fraud: 3.2 million await reimbursement and government seeks fiscal space

The latest federal government report, released on Friday night, the 13th, shows that 3.2 million people have already contested irregular deductions made from their INSS (National Institute of Social Security) payments. The federal government, however, is awaiting a decision from the Supreme Federal Court (STF) so that the payment is excluded from the tax rules.

“We presented the payment plan proposal and once this plan is validated and the Supreme Court authorizes us to issue an extraordinary credit, we will be able to present a payment schedule to retirees and pensioners,” stated the Attorney General of the Union, Jorge Messias, in an interview with 'Voz do Brasil'.

The Attorney General's Office (AGU) filed a lawsuit requesting authorization from the Supreme Court to open an extraordinary credit to return the discounted amounts. These resources would not be included in the spending limits for the years 2025 and 2026.

Accountability of entities

The government requested the freezing of R$2.5 billion from 12 entities under investigation to cover these payments, but this money has not been effectively recovered and there is no forecast as to whether it will be, since the investigation suspects that some of the entities were just fronts.

The AGU also requested that the STF suspend all ongoing legal proceedings in the country that seek to hold the Union and the INSS responsible for undue discounts.

“We are saying: ‘don’t worry, the government will make the payment, you don’t need to go to court’. You only go to court when your claim is resisted. This is not the case. The government is guaranteeing the payment. But so that there is no harm to any retiree or pensioner, we are asking for the suspension of the statute of limitations because we want them to be protected and not have their rights violated”, said Messias.
