The introduction of restrictions on the consumption of tea or food directly in the workplace is entirely acceptable on the part of the employer, provided that this provision is enshrined in the internal regulations of the company and employees are given the opportunity to leave the work area during the lunch break.
Lawyer Olga Vladimirova stated this in a conversation with RIA Novosti. She clarified that employers have the authority to establish internal rules of conduct, including introducing restrictions on eating directly in the work area.
However, such a ban is only legitimate in a situation where the employee has the opportunity to take a lunch break in a specially equipped place. According to Vladimirova, if the employee does not have alternative conditions for eating, and disciplinary measures are applied for violating the established ban, such a restriction may be recognized as unlawful.
The lawyer also recalled that current legislation prohibits eating directly in production facilities, and for a number of enterprises, sanitary standards require the mandatory presence of special rooms intended for employee meals.
