'Apple' development in the Sinan Ateş case: Two pages of text, 1 flash drive

A new development has emerged in the ongoing trial of lawyer Serdar Öktem and former homicide bureau chief, police commissioner Mustafa Ensar Aykal, in the case involving the murder of former Ülkü Ocakları Education and Culture Foundation President and Hacettepe University faculty member Associate Professor Dr. Sinan Ateş . The Ankara 32nd High Criminal Court has issued a written notice to Apple in the US requesting the passwords to the phones of lawyer Serdar Öktem and former Ankara homicide bureau chief Mustafa Ensar Aykal.

2 PAGES OF TEXT AND 1 FLASH MEMORY

According to information obtained by ANKA News Agency, two pages of text and a flash drive were sent to the case file by Apple on August 5th. The Ateş family's lawyers applied to the Ankara 32nd High Criminal Court, requesting the documents sent by Apple and requesting their registration in the UYAP system. However, despite the absence of a confidentiality order on the case, the lawyers were not provided with the documents in question.

"THE LIMITATION ON OUR RIGHT TO ACCESS THE FILE IS UNACCEPTABLE"

Speaking on the issue, Şeyda Şahin, one of the Ateş family’s lawyers, said:

Our requests have been rejected despite having no legal basis or justification. While it has been possible for the parties' attorneys to review and obtain copies of all documents, documents, and data in the case file since the beginning of the trial, it is legally impossible for the court to impose any restrictions on this matter. This restriction on our right to access the court and the case file is not only unacceptable but also highly suspicious. We have appealed to the High Council of Judges and Prosecutors (HSK), the Bar Association, and the Ministry of Justice against the unjustified rejection of our request. From the very beginning of the process, the balance of the scales of justice has been constantly tilted against us. Our most fundamental constitutional right, the right to a fair trial, is being blatantly violated, documents in the case file are being lost, and the judiciary is being used as a tool of malicious forces. While attempts are made to cover up the truth with injustices, missing documents, and rejected requests, the scales of justice will sooner or later reveal the truth. The more we are silenced, the louder we will speak out for the truth. Let it not be forgotten that history does not judge those who hide the truth, but those who reveal it. "will write"
