According to Ferdi Durdu's report, the sixth hearing of the case held at the Malatya 3rd High Criminal Court was attended by the relatives of those who died in the rubble of the apartment building and lawyers.
Cansel Özbey, who participated in the damage assessment efforts in Malatya during the 2020 Elazığ earthquake, was heard as a witness at the hearing. Özbey said, “I participated in the damage assessment efforts in Malatya, but I do not remember the Hakimbey Apartment. We were uploading the damage assessments we made to the system of the Ministry of Environment, Urbanization and Climate Change and signing the printouts. At that time, we were taking photos of all buildings, whether they were slightly or heavily damaged, and uploading them to the system. We conducted a general damage assessment scan in the neighborhoods given to us.”
"WE WILL FILE A CRIMINAL COMPLAINT"Kerem Kaptanoğlu, one of the plaintiff lawyers, recalled that a year had passed since the Hakimbey Apartment case was started and said, “The process after the 2020 Elazığ earthquake has not been fully brought to light. The court is requesting documents from the Provincial Directorate of Environment, Urbanization and Climate Change, but they still have not sent them. We will file a criminal complaint against the Provincial Directorate of Environment, Urbanization and Climate Change. At this point, a more detailed investigation should be conducted and the deficiencies should be remedied.”
WHERE IS THE PETITION WRITTEN AFTER THE ELAZIG EARTHQUAKE?The court had asked in the previous hearing whether the petition written by Gülen Öner, who lost his life in Hakimbey Apartment on January 26, 2020, was in the Provincial Directorate of Environment, Urbanization and Climate Change. It had requested a document regarding whether any action had been taken regarding this petition. The court decided to write a confirmation to the provincial directorate due to the document not being sent, and to file a criminal complaint if no response was received, and adjourned the hearing.
"ELAZIĞ WAS DAMAGED AFTER THE EARTHQUAKE"Lawyer Kerem Kaptanoğlu said the following in his statement after the court hearing:
“There is an issue that we have wanted to be investigated from the very beginning of the trial. This is; after the 2020 Elazığ earthquake, there was damage to the Hakimbey Apartment and the residents living in the building applied to the Provincial Directorate of Environment, Urbanization and Climate Change regarding this damage. It was determined that the late Gülen Öner submitted a petition regarding these applications during the trial. This petition was included in the file. We also requested this from the Provincial Directorate of Environment, Urbanization and Climate Change through the court, but no information or documents regarding the fate of this petition were sent to the court despite our repeated requests.
It was also reflected in the court file that the officials of the Provincial Directorate of Environment, Urbanization and Climate Change gave contradictory statements on this issue. In particular, it was reflected in the court file that the statements of the Provincial Director of Environment, Urbanization and Climate Change, Cengiz Başer, who served during the 2020 Elazığ earthquake, and Katip Çiçek, who served as the Provincial Director of Environment, Urbanization and Climate Change during the February 6 earthquakes, were contradictory. We will also file a criminal complaint with the Malatya Chief Public Prosecutor's Office against the people who served in the Provincial Directorate of Environment, Urbanization and Climate Change during the 2020 Elazığ earthquake period due to the fact that our requests to the court were not fulfilled,” he said.
