CHP in motion grip: Legislation-speech

The pressures on the CHP , which became the number one party in Turkey with the votes it received on March 31, 2024, have deepened even further with the motions “to lift the legislative immunity”. A Presidential Motion was prepared for 61 of the 135 CHP deputies. It was stated that the total number of motions submitted to the Presidency of the Turkish Grand National Assembly regarding CHP deputies in the 26th, 27th and 28th Legislative Terms was 240.
The details of the 26th and 27th Legislative Term motions that BirGün obtained once again revealed the extent of the pressure on the main opposition party. It was noteworthy that a total of 13 Presidential Memorandums were prepared against CHP Chairman Özgür Özel alone during the 26th and 27th terms, which included his term as CHP Group Deputy Chairman.
INSULTING THE PRESIDENTUpon the request of the CHP TBMM Group Presidency, a list of the Presidential Memorandums sent to the Joint Committee Presidency during the 28th Legislative Term of the TBMM was prepared. It was learned that 63 of the memorandums regarding the legislative immunity of CHP deputies were prepared with the charge of "insulting the President".
ÖZEL'S MEMORANDUMSDetails of the 63 Presidential Memorandums prepared in the 26th and 27th Legislative Terms for the purpose of lifting the parliamentary immunity of CHP leader Özgür Özel were also shared. The criminal charges against Özel in the memorandums sent to the Presidency of the Turkish Grand National Assembly due to his speeches, all of which could be evaluated as “within the limits of criticism”, were listed as follows:
• Opposition to the Law on Meetings and Demonstrations: 3 motions.
• Damaging Property and Aiding This Crime: 1 warrant.
• Publicly Insulting the President: 1 memorandum.
• Insulting a Public Official Because of His/her Duty: 3 motions.
• Damaging Public Property: 1 warrant.
• Insulting the President: 2 motions.
• Insult: 1 note.
• Threats and Incitement to Commit a Crime with the Intention of Creating Fear and Panic Among the Public: 1 memorandum.
CONSTITUTIONAL RIGHTS REPORTThe number of summaries of proceedings prepared against CHP deputies on the grounds of opposition to Law No. 2911, which is being discussed on the grounds that it “restricts constitutional rights” and “turns into a crime of opposition to the AKP”, has also reached 10. It was reported that the CHP members against whom a Presidential Memorandum was prepared under Law No. 2911, which regulates the crime of “opposing the Law on Meetings and Demonstrations”, are Özgür Özel, Kadim Durmaz, Mahmut Tanal, Tuncay Özkan, Sezgin Tanrıkulu, Murat Emir and Yaşar Tüzün.
