The decree establishing a new sanctions regime for job seekers, with a new "suspension-remobilization" system, was published in the Official Journal on Saturday.
In the event of failure to fulfill their obligations under the "engagement contract," a job seeker will be sanctioned "by the suspension of at least 30%" of their benefits for a period of one to two months, indicates the decree resulting from the 2023 full employment law.
If the breach is repeated, the suspension or partial or total withdrawal of the allowance may be extended up to four months.
If the job seeker complies with his obligations, the suspension is ended, specifies this "suspension-remobilization" system.
With this system, the Ministry of Labor had defended in the spring "a logic of remobilizing people in their career path , with a global approach to their job search."
France Travail explained last month that the so-called "suspension-remobilization" sanction had "the advantage of no longer severing the support relationship." According to the operator, with the new rules, sanctions for a job seeker depend on their actual search and no longer on a simple absence from an appointment, which led to a "fairly mechanical" system of sanctions.
The new control procedure, tested since July in eight regions, "does not result in an increase in the penalty rate," the public operator added.
