Local government officials are losing patience. This law needs to be changed

- The limitation of the number of terms of office, recorded in the Electoral Code directly with the words "there is no right to be elected", is inconsistent with the Constitution of the Republic of Poland - we read in the position of the Union of Polish Cities.
As ZMP writes, statutory restrictions on the right to be elected are only possible when they are necessary in a democratic state governed by the rule of law for its security, public order, protection of health, morals or the freedoms and rights of other persons.
It should be emphasized that the restriction applies not only to passive but also to active suffrage, as it deprives the citizen-voter of the right to elect the person he supports for the next term.

Restriction to only one directly elected groupThe Union believes that there are no rational grounds for this "discriminatory and unconstitutional" provision to apply only to one group elected in direct elections. ZMP reminds that such a restriction does not apply to members of parliament, senators or councilors.
- We would like to emphasize that the municipal councils, commune heads, mayors and city presidents are subject to the recall procedure through a referendum - local government officials write.
They add that elections in recent years show that residents consciously choose their leaders. In the last local government elections, almost half of the municipal leaders were replaced, while in the parliamentary elections, 23 percent of the deputies were replaced.
- We appeal for equal treatment of all persons holding an elected office. We do not agree to deprive our residents of their democratic right to choose and decide on the future of local government communities - emphasizes ZMP.
