The clinic will come to the holiday resort? The applicant has a wrong address

The Ministry of Health has responded to a petition regarding the possibility of launching mobile clinics. - The Minister is not the competent authority to take action to establish the indicated mobile health centers (...), as the establishment and definition of the organizational principles for their operation remain within the competence of medical entities - we read.

At the beginning of the year, the Ministry of Health received a petition to increase the quality of medical services. Its author proposed that, in the event of residents' needs and the municipality's notification, the following should be launched:
- mobile health centers,
- mobile specialist clinics,
- mobile laboratories and workrooms,
- mobile pharmacies,
- seasonal facilities for medical coverage.
The latter can be imagined in summer in holiday resorts besieged by tourists.
In the ministry’s response, Dominika Janiszewska-Kajka, deputy director of the Department of Medical Affairs at the Ministry of Health, explained that the ministry left the petition without consideration because the applicable provisions of the Act on Medical Activity (Journal of Laws of 2025, item 450) allow for the provision of outpatient health services in vehicles.
- According to art. 10 of the aforementioned act, outpatient health services include primary or specialist health care services and medical rehabilitation services, provided in conditions that do not require their provision in a stationary and 24-hour mode in an appropriately equipped, permanent room. These services may also be provided in a vehicle intended for the provision of these services - we read.
The official also stressed that medical entities providing healthcare services in a vehicle designated for this purpose are obliged to meet the conditions specified in the regulations.
Among other things, they must:
- use and maintain medical devices,
- equipment of medical products,
- in vitro diagnostic devices and their accessories, and
- systems or treatment kits in accordance with the requirements of the Medical Devices Act,
- provide medical staff to provide health services,
- conclude a civil liability insurance contract within the scope specified in Article 25 paragraph 1.
However, they can freely shape the periods, days and hours of providing these services.
Finally, she pointed out that the Minister of Health is not the competent authority to take action to establish the indicated mobile health centres (...), because "the establishment and definition of the organisational principles of their operation remains within the exclusive competence of medical entities and is dependent on the individual decision of each of these entities".
