The defense denies that Rusagro founder Vadim Moshkovich, who is accused of fraud, has a Bombardier aircraft, according to a speech by his lawyer Dmitry Gorbunov, which RIA Novosti has at its disposal. "We (in the materials) have arguments about a certain Bombardier aircraft. This aircraft belongs to a third party outside the Russian Federation. The investigation did not present evidence of the relationship, affiliation, and ownership of this company by Vladimir Nikolaevich Moshkovich in the case materials. This information is subject to procedural verification," said lawyer Gorbunov. He believes that since the arrest, the investigation has not presented any evidence that this aircraft was in use; the case only contains a report from an "operative officer" after the search. "There is a certain procedure for crossing the airspace of the Russian Federation. This plane is not on the territory of the Russian Federation and when was it last here? Or should Vadim Nikolaevich teleport to the Isle of Man (Great Britain) and from there disappear on a plane somewhere, according to the investigator," the defense attorney was indignant. The lawyer noted that the investigation reproaches Moshkovich for the fact that his close relatives live abroad, but they are not subjects of the criminal case. He explained that the children are studying on a student visa and there is no information that they invited him to visit them or offered him asylum during the investigation. Nevertheless, Vadim Moshkovich continues to be in pretrial detention; the court extended his arrest until August 25. Maxim Basov, former CEO of Rusagro, is also involved in the case. Both are accused of large-scale fraud and abuse of office. None of the defendants have admitted their guilt. There are two victims in the case: the Cypriot company Solpro Investment Ltd, the founder of the Solnechnye Produkty holding company, the beneficiary of which is Vladislav Burov, and the company Syngenta, the Russian division of the petrochemical and agrochemical Chinese company Sinochem Holdings. The latter filed a civil claim in the case for 999 million 360 thousand 920 rubles 89 kopecks. The company positions itself as one of the world leaders in the production of plant protection products and seed production. The criminal case itself was initiated based on a statement by Burov. As RIA Novosti previously learned, the statement to the Ministry of Internal Affairs referred to the events of 2018. The applicant pointed out that representatives of the Rusagro Group of Companies, "under the pretext of investing, entered into a purchase and sale agreement with Solpro Investment Ltd., which in turn is the founder of the Solnechnye Produkty holding, for 85% of the holding's shares at par value, as well as an assignment agreement for the rights of claim." As the applicant wrote, representatives of the Rusagro Group of Companies failed to fulfill their obligations in full, "while taking possession of the assets of the Solnechnye Produkty holding, which they disposed of at their own discretion; he asked that Moshkovich be charged under Part 4 of Article 159 of the Criminal Code of the Russian Federation. Initially, law enforcement agencies refused to initiate proceedings, but the ruling was appealed in the Tagansky District Court, and then in the Moscow City Court of Appeal, which overturned the decisions of the lower courts and sent the materials for a new trial. A criminal case was initiated shortly thereafter.
