European hotels launch action against Booking.com, demanding millions of euros

The lawsuit will be filed in the Netherlands (where Booking is headquartered), which is intended to ensure a uniform and efficient procedure. All hotels that are claiming damages are located in Europe, apart from those that already participate in similar initiatives at the level of individual countries . New entities can register online until July 31, 2025 at www.mybookingclaim.com .

Virtually any hotel operating in Europe can join the lawsuit. The key question on the site is: “Did your hotel accept guests through Booking.com between 2004 and 2024? If so, it is likely that it has suffered damages from inflated commissions and may be entitled to compensation.”

According to industry organizations, the effects of parity clauses on hotels were significant. According to Hotrec, hotels were forced to pay inflated commissions, their business freedom was restricted, and relationships with customers were hampered. Small, independent facilities, which had the least negotiation power, suffered particularly badly.

The case is being handled by a team of experienced lawyers specializing in competition law, litigation, and economics – the same ones who led to the winning judgment of the CJEU in September 2024.

Booking.com: Hoteliers misinterpret court ruling

For Booking.com, the resistance of the entire European hotel industry is a huge blow to its image. The open call for hoteliers to join the lawsuit en masse puts the booking platform on the defensive. In a statement to the Hotel vor9 portal, Booking.com claims that it “has no information about European legal actions by hotels” and also accuses Hotrec of “false and misleading interpretations” of the CJEU ruling.
