MOSCOW, November 9 – RIA Novosti. The Judicial Panel for Economic Disputes of the Supreme Court of Russia has ruled against sturgeon farming and caviar production in the canals of the Bushma River lock in the Volga Delta, according to documents obtained by RIA Novosti.

Previously, arbitration courts of three instances rejected a claim filed by the federal budgetary institution "Volga Basin Administration of Inland Waterways," which sought to compel the fishing company "Aquatrade" to clear the lock's approach channels of 700 cages and two fish-breeding modules. The panel overturned these rulings.

Since 2006, the company has been cultivating sturgeon fish in this area – beluga, osetra, sterlet, stellate sturgeon, and ship sturgeon – and producing black caviar.

The courts dismissed the claim, agreeing with the defendant's arguments that the site is not used for shipping, and that the company's project to grow sturgeon commercially in a cage complex on the territory of the Bushminsky hydroelectric complex received positive conclusions from the state environmental expert review and Rospotrebnadzor .

In addition, in 2006, the Federal Water Resources Agency issued the company a license to use a section of the Bushma River, and in 2007, it entered into a contract with the Volga State Basin Authority for Waterways and Shipping, the plaintiff's predecessor, for the provision of services to ensure water flow in the lock chambers by raising and lowering segmental gates.

Meanwhile, in 2021, the Southern Transport Prosecutor's Office sought to have the 2007 agreement declared illegal. The court dismissed the claim due to the statute of limitations, but in its reasoning, it declared the agreement null and void, as it was concluded without the consent of the Russian Federation, the owner of the lock. Based on this conclusion, the Federal State Budgetary Institution "Volga Basin Administration of Inland Waterways" subsequently filed a lawsuit to clear the lock of its cages.
The Supreme Court of the Russian Federation , in overturning the rulings of three courts, noted that the lock is operational and that "the impossibility of its use is solely due to the actions of the defendant, who arbitrarily placed aquaculture facilities on the structure's premises." Furthermore, Aquatrade has no legal basis for using the waters. The panel also noted that the administration is deprived of the right to take measures to ensure the structure's safety.

"Considering the status of the hydraulic structure and the purpose of its construction, the defendant's use of the property for fish farming purposes is unlawful," the highest court ruled. The panel remanded the case to the lower court for a new trial.
