6-year prison sentence for husband who detained his wife: Supreme Court decision

A man living in Niğde saw his wife, whom he had been arguing with, on the road while driving. He blocked her way and forced her into the car. After an argument inside the car, the woman tried to get out, but her husband refused to let her leave, assaulting her. The husband released her after seeing his wife's mother on the road.

Following the woman's complaint, a lawsuit was filed against the husband for "deprivation of liberty," a crime stipulated in Article 109 of the Turkish Penal Code . Appearing before the Niğde 7th Criminal Court of First Instance, the defendant husband was sentenced to six years in prison for the crime.
After his objection to the local court decision was rejected by the appeals court, the defendant appealed the decision, claiming that "there was not enough evidence to prove that he committed the crime, that he should be acquitted, and that the penalty was too high."
The 8th Criminal Chamber of the Supreme Court of Appeals unanimously upheld the six-year prison sentence given to the defendant by a local court for "deprivation of liberty." The ruling stated that the evidence in the case file established that the defendant committed the act and that the sentence was in accordance with the law.
