Property inspections are starting. Up to PLN 5,000 fine for not having a contract

• Owners of holding tanks and domestic sewage treatment plants must meet certain obligations. These include mandatory inspections.
• Anyone who obstructs the conduct of an inspection shall be subject to a fine of up to PLN 5,000.
• Pouring the contents of a cesspool onto a plot, field or any property - your own or someone else's - is a punishable act. This is an offense also subject to a penalty of up to PLN 5,000.

In accordance with art. 6 sec. 1 item 1 of the aforementioned Act, property owners who dispose of liquid waste from their property are obliged to document, in the form of an agreement, the use of services performed by an entrepreneur holding a permit to conduct business in the field of emptying septic tanks and transporting liquid waste by presenting such agreements and proof of payment for these services.

"Pursuant to art. 6 sec. 5a of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, employees of the Józefów City Office will carry out inspections of the frequency of emptying cesspools (septic tanks), conclusion of agreements for the removal of liquid waste with entrepreneurs who have a permit to conduct business in the field of emptying cesspools and transporting liquid waste in the Józefów commune and possession of proof of payment of fees for these services," the local office announced.

In the case of having domestic sewage treatment plants, one should also remember about the obligation to dispose of sewage sludge (in accordance with the operating instructions of the domestic sewage treatment plant), which must also be appropriately documented, i.e. by signing a contract for the removal of sewage sludge and having proof of payment for the above service.

Property owners who do not have signed agreements for emptying septic tanks and domestic sewage treatment plants should do so immediately.

He adds that the sewage disposal service can only be performed by entrepreneurs who have a permit to conduct business in the field of emptying septic tanks and transporting liquid waste.

In accordance with the amendment to the Water Law, inspections include - as we mentioned - checking contracts with entrepreneurs performing the emptying and proof of payment.

Municipal inspections of septic tanks also apply to those located on the grounds of Family Allotment Gardens, because they are subject to the same regulations as domestic holding tanks and sewage treatment plants. Municipalities face huge fines of up to PLN 50,000 for negligence.
